Terms of Use
Last updated October 5, 2026
Previous version: August 28, 2026.
These Terms govern your use of Cutty. Cutty is built for discovering, rating, discussing, and listening to music, and for making On Air shows. Use the service lawfully, respect other people, and publish only content you have the right to share.
Acceptance of these Terms
By downloading, accessing, or using Cutty, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use Cutty on behalf of an organization, you represent that you are authorized to accept these Terms for it.
Eligibility and accounts
You must be at least 13 years old and legally able to agree to these Terms. If the law where you live requires permission from a parent or guardian, you may use Cutty only with that permission.
Give us accurate account information and keep your sign-in methods secure. You are responsible for activity performed through your account. Notify us promptly if you believe your account has been compromised. You may not impersonate another person, sell or transfer an account, or create an account for someone without permission.
Your license to use Cutty
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Cutty for its intended purposes on devices you own or control. The Apple Standard Licensed Application End User License Agreement also applies to the iOS app where required by the App Store.
This license does not let you copy, sell, rent, sublicense, distribute, reverse engineer, bypass security, extract source code except where applicable law expressly permits it, or use the service to build a competing product.
Your content
You keep ownership of ratings, notes, reviews, comments, profile information, images, playlists, and other content you submit. You are responsible for that content and must have all rights and permissions needed to publish it.
You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute your content only as needed to operate, secure, and improve Cutty and to make the content available according to the feature and visibility settings you choose. This license ends when the content is deleted from active systems, except for reasonable backup retention, content other users have independently shared, and records we must retain for safety or legal reasons.
You may remove your content using available app controls. Deleting your account is governed by the account-deletion section below.
On Air shows and voice breaks
On Air lets you make radio-style shows from songs you pick and your own voice breaks, and publish them on your station. Your shows, voice recordings, station details, and comments are your content: you keep ownership, and you give us the license described above. For shows, that license includes hosting, streaming, playing, and showing them, including your voice breaks, to the people who can hear them. A public show can be seen and heard by anyone, including people who are not signed in.
When you make a show:
- Songs come from Apple Music's catalog. Making a show does not give you or anyone else rights in the music.
- Use only your own voice in voice breaks. Do not use them to play music, recordings, or anyone else's voice.
- Public shows must be suitable for everyone 13 and up. Do not put sexual content or sexual descriptions, graphic violence, or anything that promotes drug use or self-harm in your voice breaks, show titles, or station details. Songs that Apple Music marks as explicit are allowed.
- Follow these Terms and the Community Guidelines in your shows, voice breaks, titles, and comments.
Comments on public shows must also be suitable for everyone 13 and up. The rules above for voice breaks, show titles, and station details apply to them too.
Shows go public without review. In the app, signed-in listeners can report a show, a comment, or a voice break in a public show, and anyone can report one to Cutty Support. We may hide or remove shows, voice breaks, and comments, and restrict or suspend accounts, including their ability to make or publish shows, as described in Reporting, blocking, and moderation. Copyright owners can also send a notice as described in Copyright complaints.
Acceptable use
You may not use Cutty to:
- Break the law, violate another person's rights, or encourage unlawful conduct.
- Post harassment, threats, hate, targeted abuse, sexually exploitative content, or content that endangers minors.
- Post content you do not have permission to share, including infringing music, images, or personal information.
- Impersonate others, misrepresent affiliation, manipulate engagement, send spam, or coordinate deceptive activity.
- Upload malware, probe for vulnerabilities, interfere with service operation, evade access controls, or access another account without permission.
- Scrape, harvest, or use automated systems to access the service except through an interface we expressly provide or with our written permission.
- Abuse reporting, blocking, authentication, playback, or other features.
Reporting, blocking, and moderation
You can report objectionable content or accounts and can block other accounts through the relevant menu in Cutty. We may review reports, remove or limit content, restrict features, preserve evidence, warn or suspend accounts, or terminate access when we reasonably believe content or conduct violates these Terms, threatens safety, exposes the service to risk, or must be addressed by law.
We are not obligated to pre-screen every item and cannot guarantee that all objectionable content will be removed immediately. Do not use Cutty to report an emergency; contact the appropriate emergency service.
Copyright complaints
Send copyright notices and counter-notices to the contact listed under Copyright notices on our Support page.
If you believe content on Cutty, such as a show, voice break, comment, review, or image, infringes your copyright, send a notice that includes:
- The copyrighted work you believe is infringed.
- The content you believe infringes it, and where it is on Cutty, such as the show, station, or profile, so we can find it.
- Your name, postal address, telephone number, and email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
- Your physical or electronic signature.
We may remove or disable the content and tell the person who posted it, including by sending them a copy of your notice.
If your content was removed and you believe that was a mistake or misidentification, you can send a counter-notice that includes:
- The removed content and where it appeared on Cutty.
- Your name, postal address, telephone number, and email address.
- A statement under penalty of perjury that you believe in good faith the content was removed by mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for your address or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who sent the notice.
- Your physical or electronic signature.
We send a copy of the counter-notice, including your contact details, to the person who sent the notice. Unless they tell us that they have filed a court action, we may restore the content if we still have it.
In appropriate circumstances, we suspend or terminate the accounts of people who repeatedly infringe copyright. Do not send a notice or counter-notice that you know is false; you may be liable for damages.
Apple Music and third-party services
Cutty uses MusicKit and Apple Music catalog information to support search, artwork, previews, playback, and music actions you request. Apple controls catalog availability, subscription eligibility, playback, and library behavior. Full-length Apple Music playback may require an Apple Music subscription. Catalog entries, artwork, links, and playback may change or become unavailable without notice.
Cutty may link to Apple Music, Spotify search, or other third-party services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services and do not grant rights to their content, trademarks, or technology.
On Air offers available full tracks streamed from Audius after you choose to join or play, without an Apple Music subscription or Audius account. Audius content remains subject to provider availability, access restrictions, and applicable license conditions. The Audius API Terms, Audius Privacy Policy, and Open Music License describe those services and content rights. Record attribution and source links are available in Music credits. Listening does not give you ownership of a recording or permission to download, copy, or reuse it beyond its applicable license. Cutty does not offer offline Audius downloads.
Cutty uses YouTube API Services to play music videos and songs in On Air shows in YouTube's embedded player. YouTube controls its videos, ads, and playback, and videos may change or become unavailable without notice. By using Cutty, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's handling of information is described in the Google Privacy Policy.
Our service and intellectual property
Cutty and its software, design, branding, and service content—other than user content and third-party materials—are owned by us or our licensors and are protected by applicable law. These Terms grant only the limited license described above. No other rights are transferred.
If you send feedback or suggestions, you allow us to use them without restriction or compensation, but you are not required to provide feedback.
Changes to the service
We may add, change, suspend, or discontinue features, including On Air shows, social features, catalog integrations, and beta functionality. We will try to provide reasonable notice when a change materially affects your use, but urgent security, safety, legal, or technical changes may take effect immediately.
Account deletion, suspension, and termination
You may stop using Cutty at any time. You can delete your account from Profile → Settings → Delete Account. Deletion removes application-owned account data and starts deletion of the associated authentication identity, subject to limited backup, safety, and legal retention described in the Privacy Policy.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or legal exposure, interfere with the service, or if suspension is required to protect users or comply with law. When appropriate, we may give notice and an opportunity to address the issue. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations of liability, will survive.
Disclaimers
To the fullest extent permitted by law, Cutty is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not promise uninterrupted or error-free operation, that content will always be accurate or available, or that the service will meet every requirement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Ratings, reviews, comments, playlists, and other user content reflect the views of their authors, not Cutty. They are provided for discovery and discussion, not as professional advice.
Limitation of liability
To the fullest extent permitted by law, we and our service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, use, profits, or opportunities arising from or related to Cutty. Nothing in these Terms limits liability that cannot lawfully be limited, and mandatory consumer rights remain unaffected.
Changes to these Terms
We may update these Terms as the service changes. The date above shows when they were last revised. If a change materially affects your rights, we will provide reasonable notice in the app or by another appropriate method before it takes effect when required. Continuing to use Cutty after updated Terms take effect means you accept them. We may also ask you to accept updated Terms in the app before you use a feature, such as making shows.
General
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, acquisition, financing, reorganization, or sale of assets. Applicable mandatory consumer-protection rights are not limited by these Terms.
